These Terms of Service ("Terms") govern your access to and use of the AirGuard device and associated mobile and web applications (the "Services"), operated by AirGuard LLC ("we", "us", or "our"). By purchasing and using the AirGuard device or accessing our services, you agree to be bound by these Terms.

1. Overview of Services

AirGuard is an AI-enabled environmental monitoring device that detects and predicts the presence of mold and other indoor air quality concerns. Customers may purchase the device and receive real-time alerts, predictive insights, and detailed environmental reports via our app.

2. User Eligibility

You must be at least 18 years of age to use the Services. By using our Services, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

To access features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Device Purchase and App Access

Device Sales: AirGuard devices may be purchased through our website or authorized resellers. Each device includes a license to connect with the AirGuard mobile and web apps.

App Usage: The AirGuard app provides environmental alerts, mold detection reports, and system notifications based on AI analysis.

Subscription Services: Some features may require an active subscription. 

5. Data and Privacy

Your use of the Services may involve the collection and use of environmental data from your location. All data is handled in accordance with our Privacy Policy, which outlines how we collect, use, and protect your personal and environmental data.

6. AI Predictions and Disclaimer of Use

AirGuard uses sensor-based, trained Artificial Intelligence models to monitor air quality and estimate the likelihood of mold presence or conditions favorable to mold growth.

The system provides informational insights and should not be used as a diagnostic tool or as a substitute for professional mold inspection or remediation. AirGuard does not identify mold species or determine the extent of contamination.

While we strive for high accuracy, the system’s predictions depend on environmental variables, device placement, and other factors, and may occasionally produce false positives (alerts where mold is not present) or false negatives (no alert where mold exists). These limitations are inherent to any predictive model.

When the device issues an alert or indicates elevated mold likelihood, users are strongly advised to consult a qualified Indoor Environmental Professional (IEP), Industrial Hygienist, or other certified mold specialist.

AirGuard and its manufacturers disclaim all liability for damages, remediation costs, or health consequences arising from actions taken solely based on the device’s data without professional follow-up.

7. User Responsibilities

You agree to:

• Install and maintain the AirGuard device according to provided instructions.
• Keep your account information up to date.
• Not use the Services for unlawful or unauthorized purposes.

8. Intellectual Property

All software, firmware, designs, algorithms, and related materials associated with the AirGuard device and Services are the exclusive property of AirGuard LLC and are protected by intellectual property laws.

By purchasing or using AirGuard, you agree not to:

• Copy, modify, translate, reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of the device, app, or platform.
• Circumvent any security or access controls.
• Reproduce or distribute any part of the Services or device design without written consent from AirGuard.

All intellectual property rights in and to the AirGuard Products and Services remain with AirGuard LLC. These restrictions survive the end of your use of the product or Services.

9. Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms. You may also cancel your account or subscription at any time through your account settings.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, or consequential damages
• Any mold damage, health impact, or property loss
• Device misuse or improper installation

Our liability in any case is limited to the amount paid for the product or services in the 12 months preceding the event giving rise to the claim.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the app or our website. Continued use of the Services after such updates constitutes your agreement to the revised Terms.
